Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of the website at somamockups.studio and the mockup generation features offered through it (together, the “Service”), operated by Soma Mockup Studio (“Soma”, “we”, “us”, or “our”). Please read them carefully.

By accessing or using the Service you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.

1. Acceptance of these terms

These Terms form a binding agreement between you and Soma. By using the Service you confirm that you have read, understood, and agree to them, and that you have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.

2. Definitions

  • “Service” means the Soma website and its mockup generation features.
  • “Your Content” means any logos, images, text, or other material you upload or provide to the Service.
  • “Generated Images” means the mockups and other outputs the Service produces from your inputs.

3. Eligibility

You must be at least 16 years old to use the Service. By using it you represent that you meet this requirement and that your use complies with all laws that apply to you.

4. The Service

Soma generates AI mockups from inputs you provide. The Service is currently offered as a preview, on an “as is” basis, and may change, be limited, or be paused at any time. Features available during the preview may differ from those offered in any future paid version. We do not guarantee that the Service will be uninterrupted, error free, or that the Generated Images will meet your specific expectations.

5. Your content

You keep all rights you already hold in Your Content. You represent and warrant that you own or have all necessary rights, licenses, and permissions to upload and use Your Content, and that it does not infringe the intellectual property, privacy, or other rights of any third party.

You grant us a limited, non exclusive, worldwide, royalty free license to host, process, and adapt Your Content solely to the extent necessary to operate the Service and produce your result. This license ends when we have finished processing Your Content, except where retention is required to comply with the law.

6. Generated images

You may use the Generated Images you create, subject to these Terms and to the terms of the underlying AI model provider (Google). You are responsible for ensuring that your use of the Generated Images is lawful and does not infringe the rights of others, for example where Your Content includes third party trademarks or copyrighted material.

The Generated Images are produced by an automated model and may contain inaccuracies or artefacts. We make no representation that they are fit for any particular purpose, and you should review them before relying on or publishing them.

7. Free preview and generation limits

The free preview includes a limited number of generations (3). We may change these limits at any time. If we introduce paid plans in the future, they will be subject to separate pricing and terms that we will make available before you purchase.

8. Acceptable use

When using the Service you agree that you will not:

  • upload or generate content that is unlawful, infringing, defamatory, hateful, or otherwise harmful;
  • upload content you do not have the right to use, or use the Service to infringe anyone’s intellectual property or privacy;
  • attempt to reverse engineer, decompile, scrape, or otherwise extract the Service’s underlying prompt system, models, or source;
  • interfere with, disrupt, or place an unreasonable load on the Service, or attempt to gain unauthorised access to it;
  • use the Service to build a competing product, or to develop or train a machine learning model;
  • use the Service in any way that violates applicable law.

We may remove content or restrict access if we reasonably believe these rules have been broken.

9. Our intellectual property

The Soma name, brand, logo, website, designs, and the underlying generation system, including its prompt architecture and software, are owned by us or our licensors and are protected by intellectual property law. Nothing in these Terms transfers any of those rights to you. You may not use our brand or marks without our prior written permission.

10. Third party services

The Service relies on third party providers, including Google for image generation, Vercel for hosting, and Formspree for handling form submissions. Your use of features that depend on these providers may also be subject to their terms. We are not responsible for the acts or omissions of third party providers.

11. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the Service will be available, uninterrupted, secure, or error free, or that defects will be corrected.

12. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive losses, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded or limited, including for death or personal injury caused by negligence, or for fraud. Your statutory rights as a consumer are not affected.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and reasonable expenses arising out of Your Content or your breach of these Terms, to the extent permitted by applicable law.

14. Suspension and termination

We may suspend or end your access to the Service at any time if you breach these Terms or if we discontinue the Service. You may stop using the Service at any time. The sections that by their nature should survive termination, including those on intellectual property, disclaimers, liability, and governing law, will continue to apply.

15. Changes to the Service and these terms

We may modify the Service or these Terms from time to time. When we change the Terms, we will update the date at the top of this page, and where the changes are significant we will take reasonable steps to notify you. Your continued use of the Service after an update means you accept the revised Terms.

16. Governing law and jurisdiction

These Terms are governed by the laws of Germany, without regard to its conflict of law rules. The courts of Germany will have jurisdiction over any dispute arising out of or in connection with these Terms, except where mandatory consumer protection law gives you the right to bring proceedings in the country where you live.

17. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of it. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding the Service. You may not assign these Terms without our consent, and we may assign them in connection with a reorganisation or sale of our business.
